1. Introduction

These Terms of Use ("Terms") govern access to and use of NexCustom (the "Application" or the "Service"), operated solely by SUKUT LLC ("we", "us", "Application Developer").

THIS APPLICATION IS SOLELY PROVIDED BY SUKUT LLC (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

By accessing or using NexCustom, you agree to be bound by these Terms.

2. Relationship to Etsy

NexCustom is an independent third-party application that integrates with Etsy via the Etsy API. It is not affiliated with, endorsed by, or operated by Etsy.

You acknowledge and agree that:

• We, and not Etsy, are (i) the sole person or entity providing the Application to Application users; and (ii) the sole person or entity responsible for invoicing and collecting any fees (including any applicable taxes) from Application users for the Application.
• Etsy bears no responsibility for charging fees or taxes to Application users.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract.

4. Service Description

NexCustom enables Etsy sellers to automate the collection of customer photos, preview customized products, and retrieve customer-approved uploads for order fulfillment.

5. Etsy API Usage and Data Display

You acknowledge and agree that:

• Etsy platform data is dynamic and may change frequently.
• NexCustom will not display listing content more than six (6) hours older than the corresponding content on Etsy.
• NexCustom will not display other Etsy content more than twenty-four (24) hours older than Etsy's version.
• Etsy data is not cached or stored longer than reasonably necessary to provide the Service.

6. Data Processing Role

With respect to Etsy Member personal data accessed via the Etsy API:

• SUKUT LLC acts solely as a service provider / data processor to the Etsy seller.
• Data is processed only to fulfill the seller's instructions and the Service functionality.
• Sellers remain responsible for lawful collection and disclosure to their customers.

7. Fees and Payments

All fees related to NexCustom are charged by SUKUT LLC. Etsy bears no responsibility for billing, payment collection, or tax handling.

8. Withdrawal and Termination

If NexCustom is discontinued or withdrawn:

• We will provide at least thirty (30) days' prior written notice to Etsy and affected sellers, unless Etsy requires or permits otherwise.
• During this period, reasonable transitional support will be provided.

We may suspend or terminate access for violations of these Terms or applicable law.

9. Intellectual Property

NexCustom and its underlying technology are owned by SUKUT LLC. Users retain rights to their content.

10. Disclaimers and Limitation of Liability

The Service is provided "as-is" and "as available." SUKUT LLC disclaims all warranties to the maximum extent permitted by law and limits liability accordingly.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
